What is the federal overtime rate under FLSA?

Under the Fair Labor Standards Act (FLSA), non-exempt employees must be paid at least 1.5× their regular hourly rate (commonly called "time and a half") for all hours worked over 40 in a workweek. Federal law does not require overtime for working more than 8 hours in a single day — that's a California rule.

How does California overtime work?

California has both daily and weekly overtime protections under California Labor Code § 510. Employees earn 1.5× for hours over 8 in a single day and 2× (double time) for hours over 12 in a single day. On the 7th consecutive day of a workweek, the first 8 hours are at 1.5× and any hours beyond that are at 2×. Weekly overtime (over 40 hours) also applies.

Who is exempt from overtime under FLSA?

Executive, administrative, and professional employees paid on a salary basis of at least $684/week (as of January 2025) are typically exempt. Outside salespeople, certain computer professionals, and highly compensated employees (over $107,432/year) may also be exempt. Being paid a salary doesn't automatically make you exempt — the job duties test also matters.

Does overtime reset every week?

Yes. FLSA overtime is calculated per workweek — a fixed 7-consecutive-day period set by your employer. Hours do not carry over between weeks. A biweekly paycheck covers two workweeks, but overtime is still calculated independently for each week. Your employer cannot average two weeks together to avoid paying overtime.

Can my employer give comp time instead of overtime pay?

Private-sector employers generally cannot legally substitute comp time for overtime pay under FLSA. State and local government employers can offer comp time at a rate of 1.5 hours per overtime hour worked. Some states have additional rules. If your private employer offers comp time, check if this violates FLSA.

What is double time and when does it apply?

Double time means 2× your regular hourly rate. Federal FLSA does not require double time — it's primarily a California rule. In California, double time applies to hours over 12 in a single workday and to all hours on the 7th consecutive workday (after the first 8 hours, which are 1.5×). Some union contracts may also include double-time provisions in other states.
